Terms of Service

Sportech365 provides a digital platform for sports federations, leagues, clubs, academies, and other sports organizations, covering competition management, athlete registration and licensing, club and academy administration, referee and official delegation, communication, reporting, and data analytics.

We may add, change, or discontinue features of the Service from time to time. We will make reasonable efforts to notify Clients of material changes that affect their use of core functionality.

You must provide accurate, current information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of login credentials and for all activity that occurs under your account.

Access to the Service is role-based: federation administrators, league or club managers, referees, coaches, and other users are granted permissions appropriate to their role. You are responsible for assigning and reviewing access within your own organization.

You must notify us promptly at contact@deeex.de if you become aware of unauthorized access to your account.

“Client Data” means the data your organization submits to the Service, including athlete, official, club, and competition records. As between you and Sportech365, you retain all rights to your Client Data.

You grant Sportech365 a limited license to host, process, and display Client Data solely as necessary to provide, maintain, and support the Service, including generating the dashboards, schedules, evaluations, and reports the Service produces on your behalf.

You are responsible for the accuracy of the data you submit and for having the necessary rights and consents to provide personal data of athletes, officials, staff, and other individuals to the Service.

When using the Service, you agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code of the Service, except where permitted by law.
• Use the Service to store or transmit unlawful, defamatory, or infringing content.
• Attempt to gain unauthorized access to another organization's data, accounts, or systems.
• Interfere with or disrupt the integrity or performance of the Service, including through automated scraping or load testing without our written consent.
• Use delegation, evaluation, or scheduling data generated by the Service to circumvent the eligibility or conduct rules of your federation or league.

Access to paid tiers of the Service is governed by the order form, subscription agreement, or invoice agreed between your organization and Sportech365. Fees are payable in accordance with the terms stated there.

Unless otherwise agreed in writing, fees are non-refundable and exclusive of applicable taxes, which you are responsible for. Late payments may result in suspension of access after reasonable notice.

The Service, including its software, design, workflows, and the Sportech365 name and logo, is the property of Sportech365 and its licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, branding, or underlying platform technology beyond the limited right to use the Service as intended.

Each party agrees to protect the other's confidential information with the same degree of care it uses for its own confidential information, and not less than a reasonable degree of care, and to use it only as necessary to perform its obligations under these Terms.

Our collection and use of personal data in connection with the Service is described in our Privacy Policy, which forms part of these Terms. Where Sportech365 processes personal data on your behalf as part of the Service (for example, athlete or official records your organization submits), we act as a processor and will enter into a data processing agreement on request.

We aim to keep the Service available and performant, but we do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where practical. Support channels and response expectations may be set out in your order form.

These Terms remain in effect for as long as you use the Service or for the term stated in your order form. We may suspend or terminate access if you materially breach these Terms and do not remedy the breach within a reasonable period after notice, or immediately in cases of security risk or unlawful use.

On termination, we will make Client Data available for export for a reasonable period and will delete or anonymize it thereafter, except where retention is required by law.

The Service is provided “as is” and “as available.” Except as expressly stated in a written agreement between you and Sportech365, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

To the fullest extent permitted by law, Sportech365 will not be liable for indirect, incidental, special, or consequential damages, or loss of data, revenue, or goodwill, arising from your use of the Service. Our total liability for any claim arising from these Terms is limited to the amount paid by you for the Service in the twelve months preceding the claim.

You agree to indemnify and hold Sportech365 harmless from claims arising out of your misuse of the Service, your Client Data, or your violation of these Terms or applicable law.

These Terms are governed by the laws of Germany, without regard to conflict-of-law principles. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Berlin, Germany, unless otherwise required by applicable law.

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as an in-app notice or an email to your account administrator, before the changes take effect.
